I. Предмет
Чл. 1. (1) Настоящите общи условия са предназначени за регулиране на отношенията между Посредническа Агенция "Ейт и Ейт" ООД, ЕИК: 206613003 (наричано за краткост „Доставчик“) и Посетителите на уеб-сайта: "Кандидати" (наричани за краткост „Посетителите“).
(2) Чрез достъпа и зареждането на Сайта, Посетителите се съгласяват да бъдат обвързани от настоящите Общи условия и всички последващи промени в тях, като се задължават да ги спазват.

Чл. 3. Сайтът … предоставя на Посетителите информация относно дейността, услугите и цените на Доставчика, както и достъп до публикуваните новини и материали, възможност за публикуване на мнения и коментари, преглед на каченото съдържание и всякакви действия, които са необходими за пълноценното използване на Сайта по неговото предназначение.
III. Интелектуална собственост
Чл. 4. (1) Всички публикации в Сайта са изключителна интелектуална собственост на Доставчика и са обект на закрила по Закона за авторското право и сродните му права, като те не могат да бъдат използвани по какъвто и да било начин без предварителното писмено съгласие на Доставчика.
(2) Изображенията в Сайта, както и другите визуални елементи, представляващи интелектуална собственост на Доставчика не могат да бъдат използвани и възпроизвеждани по какъвто и да било начин от трети лица без неговото предварително писмено съгласие.
(3) Всяко нерегламентирано използване на материалите, публикувани в Сайта, без разрешение на Доставчика, представлява нарушение, за което нарушителят носи гражданска, административно-наказателна и наказателна отговорност в съответствие с действащото българско законодателство.
Чл. 5. (1) Доставчикът не разрешава използването по какъвто и да било начин на съдържанието на Сайта чрез визуализация на всички или част от материалите, публикувани в него, в друг сайт.
(2) Препращането към материали в Сайта от други сайтове е допустимо, ако е извършено в съответствие с добрите нрави и търговска практика и ако с препращането и начините на представяне на препратката не възниква съмнение относно авторството на Доставчика върху материалите, така че Посетителите не биват въвеждани в заблуждение.
IV. Защита на личните данни
Чл. 6. (1) Доставчикът предприема мерки за защита на личните данни на Посетителите съгласно Регламент (ЕС) 2016/679 на Европейския парламент и на Съвета относно защитата на физическите лица във връзка с обработването на лични данни и относно свободното движение на такива данни, изискванията на европейското и българското законодателство, както и Политиката за защита на личните данни, обявена на сайта й в Интернет.
(2) Доставчикът не изпраща идентифицираща информация на трети лица, като техническа информация и информация за ползването на Сайта от Ползвателите се обработва от дружеството, поддържащо платформата, на която е поставен Сайта при спазване на изискванията за защита на личните данни и информационна сигурност.
(3) Доставчикът събира и обработва данни за „бисквитки“ съгласно своята Политика, с която Посетителите се запознават при зареждането на Сайта.
V. Изменение на общите условия
Чл. 7. (1) Настоящите Общи условия могат да бъдат изменяни от Доставчика по всяко време, като своевременно на Сайта се публикуват изменените Общи условия, заедно със съобщение до Посетителите за извършените промени.
(2) Измененията в настоящите общи условия имат действие за всички Посетители от момента на обявяването им на Сайта.
VI. Ограничаване на отговорността
Чл. 8. (1) Доставчикът предоставя достъп до съдържанието на Сайта такова каквото е и не гарантира, че насоките в материалите в Сайта водят до целените от Посетителите резултати.
(2) Доставчикът не носи отговорност за вреди и пропуснати ползи на Посетителите причинени от съдържащи се в публикуваните на Сайта материали.
(3) Доставчикът не носи отговорност за вреди, причинени от Посетителите на третите лица вследствие използването на Сайта и съдържащите се в него материали.
VII. Други разпоредби
Чл. 9. Посетителите на Сайта се задължават да спазват етичните норми и да не нарушават репутацията на Доставчика при използването на Сайта и съдържащите се в него материали.
Чл. 10. За неуредените в тези общи условия въпроси, свързани с изпълнението и тълкуването на този договор, се прилагат разпоредбите на действащото законодателство на Република България.
Чл. 11. Настоящите общи условия влизат в сила за всички Посетители на Сайта считано от … 2019 г.

Eight and Eight Ltd. respects the privacy of its customers and guarantees maximum protection of their personal data processed for providing staff recruitment and selection services, in particular - seafarers, as well as performance of related activities. The present Privacy Policy is based on the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement and repealing Directive 95/46 / EC (herein after: “Regulation (EU) 2016/679”). All amendments to the Privacy Policy shall enter in force upon publishing the updated content on our website: www.eightandeight.bg. The privacy policy shall apply to your personal data if you are a natural person or a representative of a legal entity that uses or wishes to use services provided by Eight and Eight Ltd.
1. Who processes and who is responsible for your personal data?
Eight and Eight Ltd. is a business enterprise registered in the Commercial Register at the Registry Agency with UIC 206613033, which collects, processes and stores personal data under this policy terms and conditions. Eight and Eight Ltd. is also entered in the Labor Agency national register as an enterprise providing personnel recruitment and selection services and in particular - seafarers. Eight and Eight Ltd. is entered in the Labor Agency public register pursuant registration order № 3282, as well as for personnel recruitment and selection serving in other countries pursuant registration order: № 3206. Eight and Eight Ltd. is a personal data processor within the meaning of Regulation (EU) 2016/679 and the Personal Data Protection Act. 2. What personal data, for what purposes and on what legal basis do we process?
2.1. Depending on the specific goals and grounds, Eight and Eight Ltd. processes the following personal data individually or in combination:
A) Data provided by you and serving for identification and fulfillment of Eight and Eight Ltd. contractual obligations with clients:
• full names, Civil ID or client personal number, address, telephone and / or e-mail address for contact with you, or a contact person specified by you;
• full names, Civil ID, address and other data of your proxy, specified in the document with which you have authorized him to represent you in front of Eight and Eight Ltd.;
• full names, Civil ID, address and other details of your legal representative;
• full names, Civil ID, address and other data of persons indicated as contact persons of legal entities;
• full names, Civil ID, address and other data of persons indicated as recipients of invoices;
• number, date of issue, validity and issuer of an identity document;
• data collected upon payment made to Eight and Eight Ltd. credit or debit card number, bank account and other banking and payment information collected during and processed in connection with the payment by bank transfer;
• data on the services used by you from the portfolio of Eight and Eight Ltd.;
• household information, marital status, demographic information and other data you provide when participating in our surveys, or other feedback you provide us about the products, services or preferences you use for the services we provide.
B) Data prepared and generated by Eight and Eight Ltd. in the process of providing the services:
• detailed reports on monthly bills / invoices and amount of liabilities contained therein;
• voice recording of telephone conversations initiated by our operator from a call center when offering services;
• video recording during a visit to Eight and Eight Ltd. Headquarters by SSCC or video surveillance equipment for security purposes in order to provide smooth service to employees and visitors in Eight and Eight Ltd. office;
• video or photography, made in accordance with the pre-announced seasonal or promotional campaigns, organized by Eight and Eight Ltd. and addressed to the general public;
• information about the type and content of contractual relationship, as well as any other information related to the contractual relationship, including e-mails, letters, information about your requests, complaints, demands, grievances and other feedback we may receive from you ;
• data concerning specific complaint regarding the service provided by Eight and Eight Ltd.;
• data for your preferred services.
2.2. Objectives and legal grounds for processing personal data:
A) Processing personal data necessary for the effect or performance of a contract for provision of personnel recruitment and selection services, in particular - seafarers. Eight and Eight Ltd. processes your personal data for the following purposes:
• Identification of a client when: Effecting, amending and terminating a contract for the provision of personnel recruitment and selection services, in particular seafarers;
• Updating your personal data or information about the services used upon your request for correction / modification of data / services;
• Serving and responding to customer complaints / inquiries / demands; Adjustments of amounts due if necessary;
• Payment of bills, rescheduling, remittance, or deferral of amounts due;
• Processing by data processors - assignment, reporting, acceptance, payment;
• Providing protection and security on the Eight and Eight Ltd. site.
B) In fulfilling its legal obligations, Eight and Eight Ltd. processes your data for the following purposes:
• Drafting proposals for effect of contracts and draft contracts;
• Providing information on contracts, protocols, monthly bills / invoices;
• Providing information about the client and services used by him on request / inquiry / inspection by a competent authority;
• Management of granted consents;
• Issuance of invoices, preparation of a detailed report on the consumption of the services;
• Tax and social security control by relevant competent authorities;
• Providing information to the Consumer Protection Commission and the Personal Data Protection Commission concerning the implementation of liabilities in the relevant laws;
• Providing information to the court and third parties in court proceedings.
C) Eight and Eight Ltd. processes the relevant data provided with the client express written consent for processing with the following purposes:
• To include your name, photographs, videos and other forms of your presence in advertising and media publications of Eight and Eight Ltd. as a result of your participation in events organized by Eight and Eight Ltd. or our partners;
• To receive and / or provide information to third parties, if such information is expressly requested by you or if you have consented to receive such information.
D) Eight and Eight Ltd. also processes your personal data for our following legitimate interests:
• Clients profiling for direct marketing - Eight and Eight Ltd. uses methods to assess and analyze some aspects of customer consumption, such as services used and preferences in order to: - make offers for provision of new services and / or changing the terms and conditions of services in use by a client, such as: proposal for change in the service for more efficient use and optimize costs for the client; - preparation of information published on our website in the most appropriate way for you;
• Processing data from your accounts / invoices for other purposes compatible with the initial purpose when collected;
• Detailed data analysis of customer preferences (automatic processing in encrypted form) - Eight and Eight Ltd. performs this analysis, using the data anonymously and in a form that does not allow easy or impossible identification of personal data concerned, in order development and improvement of its product range of services;
• Judicial and out-of-court collection of receivables - in cases where it is necessary to collect the unpaid debts of Eight and Eight Ltd. clients;
• Audit by external expert accountants appointed by Eight and Eight Ltd.
3. Third parties that access and process your personal data:
3.1. Processors of personal data who, on grounds of a contract with Eight and Eight Ltd., process your personal data on behalf of Eight and Eight Ltd. or have direct / indirect access to your personal data:
• Transport / courier companies in fulfilling our contractual liabilities to provide personnel recruitment and selection services and in particular - seafarers;
• Persons who, on behalf of Eight and Eight Ltd., maintain equipment and software used to process your personal data;
• Eight and Eight Ltd. business partners in connection with activities for the provision of personnel recruitment and selection services and in particular - seafarers;
• Agencies collecting unpaid client debts, lawyers and associations / law firms acting on behalf of Eight and Eight Ltd .;
• The banks servicing your payments;
• Security companies holding a license for private security activities, processing videos from the offices of Eight and Eight Ltd. and / or maintaining other registers in the process of providing access to the same sites;
• Persons providing services for organizing, storing, indexing and destroying archives on paper and / or electronic media;
• Persons providing consulting services in various fields.
3.2. Other personal data processors to whom Eight and Eight Ltd. provides your personal data for processing on their own grounds and on their own behalf:
• Competent authorities, which pursuant an act have the authority to require Eight and Eight Ltd. to provide information, including personal data, such as - Bulgarian court or a court of another country, various supervisory authorities - Commission for Protection of Consumers, bodies with powers to protect national security and public order;
• Insurers - when effecting insurance with the mediation of Eight and Eight Ltd. in its capacity as broker providing personnel recruitment and selection services and in particular - seafarers.
3.3. Joint processors of personal data, who determine the purposes and means of processing your personal data together with Eight and Eight Ltd. :
• Shipowners or other recruitment agencies.
4. How long is your personal data stored?
4.1. The storage term of your personal data depends on the purposes of processing for which they are collected:
• The personal data processed for the purpose of effecting and performing a contract for the provision of a Service shall be stored for the contract term and until the final settlement of all financial matters between the parties;
• The personal data processed for the purpose of issuing accounting / financial documents for tax and insurance control, as well as, but not only - invoices, debit, credit notices, handover protocols, as well as contracts for the provided Services are stored for at least 5 (say: five) years after expiration of the limitation period for repayment of the public receivable, unless the applicable legislation provides for a longer period;
• The personal data required for the purposes of national security and the prevention, detection, and investigation of crimes, as well as for search and rescue operations, are stored by Eight and Eight Ltd. for a period of 6 (say: six) months;
• Eight and Eight Ltd. may store some of your personal data for a longer period until the expiration of the relevant statute of limitations in order to protect against any claims of customers in connection with the implementation / termination of the contract for services, and for a longer period in case of a legal dispute that has already arisen in connection with the above until its final settlement with an effective court / arbitration decision;
• Picture (Video) - up to 60 (say: sixty) days from the time the recording was created.
5. What are your rights in connection with the processing of personal data by Eight and Eight Ltd. and what actions should you take to protect yourself:
• access to your personal data and information, such as we have included in this Privacy Policy with respect to the data in question. You may ask Eight and Eight Ltd. for information on whether and for what purposes we process your personal data. You implement your right of access by visiting the office of Eight and Eight Ltd. and personally submit written application requesting access to your personal data. An application may also be submitted by another person provided with your notarized power of attorney;
• request that your personal data be corrected when it is inaccurate or should be supplemented in view of the purposes of processing;
• request that your personal data be deleted only in one of the following cases:
✓ they are no longer needed for the purposes for which they are processed;
✓ you have withdrawn your consent / objected to their processing and there is no other reason for such processing;
✓ personal data processing is recognized as illegal;
✓ the national or European legislation requires it;
• request that the processing of your personal data be restricted in any of the following cases:
✓ in case of disputing the accuracy of your personal data for the period necessary for Eight and Eight Ltd. to check the data accuracy;
✓ Illegal processing has been detected, but you only want to limit the processing of your personal data instead of deleting it;
✓ you want your personal data to be stored, although Eight and Eight Ltd. no longer needs it for the purposes of processing, as you will use it to establish, exercise or protect your legal claims;
✓ in case of an objection made by you against the processing of your personal data for the term of the verification of its validity;
• request the transfer of your personal data that affect you and that you have provided to us, including receiving it from Eight and Eight Ltd. in a structured, widely used and machine-readable format and transferring it to another personal data processor. Your right to transfer applies to personal data for which the following conditions are met:
✓ data processing is based on your explicit consent or contractual obligation;
✓processing is performed in an automated way.
• to object to Eight and Eight Ltd. at any time and for your personal reasons in view of the specific situation, against the processing of personal data concerning you, based on the need to perform a task of public interest or in the exercise of official powers that have been granted to us or that we have indicated that we are processing for our legitimate interest. When the objection is against the processing of your personal data for the purposes of direct marketing, including profiling for this purpose, Eight and Eight Ltd. will terminate such processing for that purpose. When the objection is against the processing of your personal data for other purposes, Eight and Eight Ltd. will answer you within a reasonable time, but not longer than one month, whether it finds the same justified and whether it will terminate the processing of personal data. data for these purposes;

Failure to provide the following information will prevent Eight and Eight Ltd. from entering into an agreement with you:
• full names, civil ID or personal number of a foreigner, address;
• full names, Civil ID, address and other data of your proxy, specified in the document with which you have authorized him to represent you in front of Eight and Eight Ltd.;
• number, date of issue, validity and issuer of an identity document;
• data collected upon payment made to Eight and Eight Ltd. credit or debit card number, bank account and other banking information collected during and processed in connection with the payment by bank transfer;
• data from your account for access to our online platform - username, history of requests and payments.
